Welcome to Human on Paper. These Terms of Use govern access to and use of the Human on Paper website, including its pages, content, features and resources (the "Website"). By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.

Human on Paper is an independent publishing and content brand operated by Natalia Sanchidrián Polo. Full operator and contact information is provided in the Legal Notice (Impressum). References in these Terms to "Human on Paper", "we", "us" or "our" include the Website operator and, where the context requires, Natalia Sanchidrián Polo.

These Terms apply to use of the Website. They do not replace the separate terms of an external retailer, marketplace, payment provider or learning platform through which a product or service may be purchased.

1. Purpose and scope of the Website

Human on Paper publishes and presents books, journals, articles, newsletters, videos, exercises, prompts, downloadable resources and other content relating principally to self-awareness, emotional growth, mindset and expansion, relationships, spirituality and personal development.

The Website may also provide information about current or forthcoming publications, author projects, events, collaborations, educational materials and links to products or services available on external platforms.

We may add, change, suspend or remove content, features or resources at any time, subject to any rights that cannot lawfully be excluded.

2. Educational and personal-development disclaimer

All content made available through Human on Paper, including content created, written, presented or shared by Human on Paper and/or Natalia Sanchidrián Polo, is provided for general informational, educational, inspirational and personal-development purposes only.

This disclaimer applies, without limitation, to content on the Website and to related books, journals, articles, newsletters, videos, audio materials, exercises, prompts, downloadable materials, social-media content and other resources published or promoted under the Human on Paper brand or Natalia Sanchidrián Polo's name.

Human on Paper publications may contain direct, ironic, emotionally intense or occasionally explicit language and may address sensitive subjects. Such language forms part of the literary and editorial expression of each work and is not intended to insult, demean or target any particular reader, individual or group.

The content is not intended to constitute, and must not be interpreted as, medical, psychological, psychiatric, psychotherapeutic, counselling, nutritional, legal, financial or other regulated or individual professional advice, diagnosis or treatment. It is not a substitute for an assessment, diagnosis, treatment plan or advice from an appropriately qualified professional who understands your individual circumstances.

Human on Paper and Natalia Sanchidrián Polo do not promise or guarantee any particular personal, emotional, psychological, relational, spiritual, professional, business, financial, health or other outcome from accessing or applying the content.

Testimonials, examples, case studies, personal stories and descriptions of experiences illustrate individual experiences only. They do not represent a promise, warranty or indication that another person will obtain the same or similar results.

Any forward-looking statement, aspiration or description of potential benefit is an expression of possibility, not a guarantee. Results depend on numerous individual and external factors.

5. Intellectual property

Unless expressly stated otherwise, the Website and its original content - including texts, book and journal concepts, exercises, prompts, frameworks, names, slogans, graphics, layout, branding, logos, photographs, videos, audio, downloadable materials and compilations - are owned by Human on Paper and/or Natalia Sanchidrián Polo, licensed to them, or otherwise used with permission. They are protected by copyright, trade mark and other applicable intellectual-property laws.

You may access and view Website content for your personal, non-commercial use. Where a resource is expressly offered for download, you may download one personal-use copy subject to any additional licence stated with that resource.

Except as permitted by mandatory law or with prior written permission, you may not copy, reproduce, republish, translate, adapt, distribute, sell, sublicense, publicly display, communicate to the public, create derivative works from, commercially exploit or present the content as your own. Removing copyright, authorship, trade mark or proprietary notices is prohibited.

No rights are transferred to you except the limited permission to use the Website in accordance with these Terms. Human on Paper and related names, logos and brand elements may not be used in a manner that suggests sponsorship, endorsement or affiliation without prior written permission.

6. Automated access, scraping and artificial intelligence

Except where mandatory law provides otherwise, you may not use bots, crawlers, scraping tools, data-mining techniques or other automated means to access, extract, reproduce, index or collect substantial parts of the Website or its content without prior written permission.

You may not use Website content, books, journals, exercises, frameworks, images or other protected materials to train, fine-tune, evaluate or supply datasets for generative artificial-intelligence or machine-learning systems, or to generate competing or substantially similar content, without prior written permission from the relevant rights holder.

Nothing in this section restricts ordinary search-engine indexing carried out in accordance with our technical settings, or uses that cannot lawfully be prohibited.

7. Acceptable use

You must use the Website lawfully and in a way that does not infringe the rights of others or interfere with the Website's operation or security.

You must not attempt to gain unauthorised access to the Website, servers, accounts or data; introduce malware or harmful code; circumvent security or access controls; impersonate another person; submit unlawful, misleading, abusive or infringing material; use the Website for fraud or unlawful commercial solicitation; or encourage others to do any of these things.

We may restrict or block access where reasonably necessary to protect the Website, users, rights holders or third parties, or to comply with law.

8. External platforms and purchases

The Website may link to books, journals, digital products, courses or other products and services offered or sold by third parties, including platforms such as Amazon or Hotmart.

Unless expressly stated otherwise, purchases are completed through the relevant external platform. Depending on the platform and the transaction, the contract may be concluded with Human on Paper, Natalia Sanchidrián Polo, the relevant retailer or another party identified during checkout. These Website Terms do not replace the contractual information and product-specific terms presented during that external purchasing process.

The purchase is governed by the applicable product terms, pricing, payment arrangements, delivery conditions, cancellation and refund rules, statutory information and privacy practices presented on the external platform. Please review that information before purchasing.

Human on Paper does not receive or store payment-card or banking information entered directly on an external platform. The external platform remains responsible for its own checkout, payment processing and technical environment, without prejudice to any mandatory rights you may have against Human on Paper, the relevant seller, retailer or other responsible party.

If Human on Paper later offers products or services for direct purchase on the Website, separate sales terms and the legally required pre-contract information will apply to those transactions.

9. Affiliate links and commercial relationships

Some links may be affiliate links or may relate to a paid, gifted or otherwise commercial collaboration. Where applicable, this will be disclosed clearly in accordance with legal requirements. Human on Paper may receive a commission or other benefit if you follow such a link or make a purchase, at no additional cost to you unless clearly stated otherwise.

Commercial relationships do not remove your responsibility to assess whether a third-party product or service is appropriate for you.

10. Third-party websites and services

Links, embedded content or references to third-party websites and services are provided for convenience or additional information. We do not control those services and do not guarantee their content, availability, security, accuracy or privacy practices.

A link or reference does not necessarily mean that Human on Paper endorses every statement, product, service or opinion offered by the third party. Your use of third-party services is subject to their own terms and policies.

11. Accuracy and availability

We take reasonable care when preparing and maintaining Website content. However, general information may become incomplete or outdated, may contain errors, or may not apply to your particular circumstances. Nothing in these Terms requires us to keep every item permanently available or continuously updated.

We do not guarantee uninterrupted, error-free or secure availability of the Website. Maintenance, technical failures, security incidents, changes by service providers or events beyond our reasonable control may affect access. We may correct errors and modify, suspend or discontinue Website content or features.

12. User communications and submitted material

If you send feedback, enquiries, suggestions, reviews, testimonials, images or other material, you confirm that you are entitled to send it and that it does not infringe another person's rights or applicable law.

Sending material does not transfer ownership to Human on Paper. We will not publish your name, testimonial, image or substantive submitted material for promotional purposes without a lawful basis and, where required, your permission. Administrative use needed to answer or process your communication is governed by our Privacy Policy.

Unsolicited creative proposals, manuscripts or ideas may not be treated as confidential unless we have agreed otherwise in writing before submission. Do not send material that you require us to keep confidential without such prior agreement.

13. Privacy and cookies

The processing of personal data and the use of cookies and similar technologies are governed separately by our Privacy Policy and, where applicable, by the cookie information and settings available on the Website.

14. Liability

Nothing in these Terms excludes or limits liability for intent or gross negligence; injury to life, body or health; fraud or fraudulent concealment; liability under the German Product Liability Act; breach of a guarantee expressly given; or any other liability that cannot lawfully be excluded or limited.

In cases of ordinary negligence, Human on Paper is liable only for breach of an essential contractual obligation whose performance is necessary for proper use of the Website and on which a user may ordinarily rely. In such cases, liability is limited to the foreseeable damage typical for that type of arrangement. The preceding limitation does not apply to injury to life, body or health or to other mandatory liability.

Subject to the preceding paragraphs and to mandatory law, Human on Paper is not liable for losses resulting from treating general educational or informational content as individual professional advice, from an unsuitable or unauthorised application of the content, or from the acts, omissions, products, services, systems or content of independent third parties.

The same limitations apply in favour of Natalia Sanchidrián Polo and any legal representatives, employees or agents to the extent permitted by law. Statutory consumer rights remain unaffected.

15. Indemnity

To the extent permitted by applicable law, users acting in the course of a trade, business or profession shall indemnify Human on Paper against reasonable third-party claims, losses and costs arising from their unlawful use of the Website, infringement of third-party rights or culpable breach of these Terms. This provision does not impose liability without fault and does not limit any mandatory rights.

This section does not apply to consumers acting wholly or mainly outside their trade, business or profession.

16. Changes to these Terms

We may update these Terms to reflect changes to the Website, our content or business model, technical or security requirements, or applicable law. The current version and its effective date will be published on the Website.

Changes apply prospectively. Where a change would require separate notice or consent under applicable law, we will provide it. Continued use of the Website after publication does not waive mandatory rights.

17. Governing law and consumer protection

These Terms and use of the Website are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, to the extent applicable.

If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory protections granted by the law of your country of habitual residence where those protections apply.

Nothing in these Terms restricts any mandatory right to bring proceedings before a competent court. Any exclusive jurisdiction agreement applies only where legally permitted.

18. Severability and no waiver

If any provision of these Terms is invalid, unlawful or unenforceable, the remaining provisions remain unaffected. The applicable statutory rule shall take the place of an invalid provision where required; the provision shall not be replaced by a clause that improperly disadvantages the user.

A failure or delay in exercising a right does not constitute a waiver of that right.

19. Language versions

The English and Spanish versions are intended to communicate the same terms. They should be interpreted consistently. If a discrepancy cannot be resolved, mandatory applicable law and the interpretation most consistent with transparency and consumer protection shall prevail.
